Terms of Service

1. Agreement

These terms govern your use of Zendly, a social media scheduling and publishing dashboard at zendly.co.za, operated by Intellium Inc. of Cape Town, South Africa. By creating an account or connecting a social media account, you agree to these terms. If you do not agree, do not use the service.

2. What the service does

Zendly lets you write posts, attach images or video, choose a publishing time, and have those posts published automatically to social media accounts you have connected and authorised. It also displays performance figures for those accounts alongside your scheduled content.

3. Accounts

You need an account to use Zendly. You are responsible for keeping your login details secure and for everything done under your account. Tell us at hello@intelliuminc.co.za if you believe your account has been accessed without your permission.

You must be 18 or older to use Zendly.

4. Connecting social media accounts

You may only connect accounts that you own or are authorised to manage. By connecting an account you confirm you have the right to publish to it.

Each connected platform has its own terms, and those apply to you in addition to these. If a platform suspends, restricts or removes your account, that is a matter between you and that platform. Access can also be revoked by you or by the platform at any time, which will stop Zendly from publishing to it.

5. Your content

You keep all rights to the content you upload and schedule. You grant Intellium Inc. only the limited permission needed to store that content and publish it to the accounts and at the times you specify. We do not use your content for any other purpose. This is set out in more detail in the Privacy Policy.

You are responsible for what you publish. You confirm that your content is yours to publish, does not infringe anyone else's rights, and does not break the law or the rules of the platform you are publishing to.

6. Acceptable use

You may not use Zendly to:

  • publish content that is unlawful, defamatory, hateful, harassing or that sexualises minors;
  • publish content to accounts you do not own or are not authorised to manage;
  • send spam, run bulk unsolicited campaigns, or operate networks of fake or automated accounts;
  • break the terms, community guidelines or API rules of any connected platform;
  • remove or alter a creator's copyright mechanisms, such as watermarks, without their consent;
  • attempt to gain unauthorised access to the service, to other accounts, or to the server it runs on;
  • resell or redistribute access to the service without our written agreement.

We may suspend or close an account that breaches this section.

7. Availability

We aim to keep Zendly running, but we do not guarantee uninterrupted service. Scheduled posts can fail for reasons outside our control, including platform outages, API changes, revoked permissions, and content rejected by the destination platform. We are not liable for a post that does not publish. Check that important posts went out.

8. Service changes

We may add, change or remove features, and platforms may withdraw the API access a feature depends on. Where a change materially reduces what the service does, we will give account holders notice by email where we reasonably can.

9. Closing your account

You may stop using Zendly and ask us to close your account at any time by emailing hello@intelliuminc.co.za. On closure we delete your data as set out in the Privacy Policy.

We may close an account that breaches these terms. Where the breach is not serious, we will give you notice and a chance to put it right first.

10. Liability

To the extent the law allows, Intellium Inc. is not liable for indirect or consequential loss, including lost profit, lost business or lost data, arising from your use of Zendly. Nothing in these terms limits liability that cannot lawfully be limited.

11. Open source software

Zendly is built on open source software licensed under the GNU Affero General Public License v3.0. Details and the source offer are on the Open Source page. Nothing in these terms limits your rights under that licence.

12. Privacy

Our handling of personal information is set out in the Privacy Policy, which forms part of these terms.

13. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
